Terms of Service
The agreement between you and EB3 HUB LLC when you use this website, submit a form, or open a client portal account.
These Terms govern your use of eb3hub.com and the client portal operated by EB3 HUB LLC ("EB3 Hub", "we", "us"). By using the site, submitting a form, or opening a portal account, you agree to them. If you do not agree, please do not use the site.
If you engage us as a client, you will also sign a separate service agreement. Where that agreement and these Terms conflict, the signed service agreement governs.
1. Who we are, and what we are not
EB3 Hub is an advisory and placement service for the EB-3 employment-based immigrant visa. We assess eligibility, prepare candidates, and match them with U.S. employers willing to sponsor.
EB3 Hub is not a law firm and does not practise law. Nothing on this site or said by our staff is legal advice, and using this site or speaking with us does not create an attorney–client relationship. Immigration filings are prepared and submitted by licensed attorneys and sponsoring employers. We are not affiliated with, endorsed by, or acting on behalf of USCIS, the U.S. Department of Labor, the U.S. Department of State or any other government agency. Please read our Legal Disclaimer — it forms part of these Terms.
2. Who may use this site
You must be at least 18 years old and legally able to enter into a contract. You may use the site only for lawful purposes and only to enquire about or manage a genuine EB-3 matter.
3. No guarantee of any outcome
The EB-3 process is controlled by U.S. government agencies and by employers, not by us. We cannot and do not guarantee:
- that you will be found eligible;
- that an employer will offer to sponsor you;
- that a PERM labor certification, I-140 petition or immigrant visa will be approved;
- that a green card will be issued;
- any particular processing time.
Timelines quoted anywhere on this site — including the "typically 3–4 years" figure — are general estimates based on past cases. Your case may take longer. Visa bulletin backlogs for your country of chargeability are outside anyone's control.
Any statement by our staff about your prospects is an opinion based on the information you gave us, not a promise.
4. Your responsibilities
You agree to:
- Give us accurate and complete information. This matters more here than in most services. Misrepresentation to U.S. immigration authorities can result in denial of your case and a permanent bar from entering the United States. If you conceal a criminal record, an immigration violation, a prior refusal or a health condition, we cannot assess your case properly and you may lose both your case and your fees.
- Tell us promptly when your circumstances change — address, marital status, passport, employment or immigration status.
- Respond to reasonable requests for documents and information within the timeframes we give you, since government stages have hard deadlines.
- Keep your portal password confidential and tell us immediately if you suspect someone else has used your account. You are responsible for activity under your account.
- Deal directly with us or with people we have identified to you in writing. See section 11 on fraud.
We may suspend or end our services if you give us false information, fail to pay, or ask us to do something unlawful.
5. Our services
What we do is described on this site and, for clients, in your service agreement. In general we assess eligibility, prepare your profile and documents, present you to potential sponsoring employers, coordinate with the attorneys handling your filings, and keep you informed of progress through the client portal.
We do not employ you, and we do not control the employer's hiring decision, the attorney's professional judgement, or any government agency's decision.
6. Fees and payments
Service fees are staged across three milestones and are set out in your service agreement before you commit to anything. Employers pay all PERM labor-certification costs, as U.S. regulations require. Government filing fees, medical examinations, translations and travel are separate from our service fees and are not included.
Full payment terms, including what is and is not refundable, are in our Refund & Payment Policy, which forms part of these Terms.
7. Client portal
Portal accounts are provided at our discretion to engaged clients. You agree not to share your login, attempt to access another client's records, probe or scan the service, upload malicious files, or copy the portal's content or design. We may suspend an account we reasonably believe is compromised or misused.
8. Acceptable use
You must not: use the site unlawfully; impersonate anyone; submit false enquiries; scrape, crawl or bulk-download content; interfere with the site's operation or security; introduce malware; or use the site to send unsolicited commercial messages.
9. Intellectual property
The content of this site — text, design, graphics, logos and code — belongs to EB3 Hub or its licensors and is protected by copyright and trade mark law. You may view and print pages for your own personal use in connection with a genuine EB-3 enquiry. You may not republish, sell or systematically copy any part of it without our written permission. "EB3 Hub" and our logo are our marks; other marks belong to their owners.
If you send us feedback or suggestions, we may use them without obligation to you.
10. Third-party services and links
The site links to services we do not control, including WhatsApp, Facebook and Stripe. We are not responsible for their content, availability or practices, and a link is not an endorsement. Job listings describe roles offered by third-party employers; the employer, not EB3 Hub, is responsible for the accuracy of its own offer and for the terms of any employment.
11. Fraud warning
Immigration services attract impersonators. EB3 Hub will never ask you to send money to an individual's personal account, to a cryptocurrency wallet, or through an informal transfer agent. We issue invoices and take payment through documented channels only. If someone contacts you claiming to represent EB3 Hub and the request looks unusual, stop and verify with us at [email protected] or (877) 920-2999 before paying anything.
12. Disclaimer of warranties
The site and its content are provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted or error-free, or that its content is complete, current or accurate — immigration rules, fees and processing times change frequently, and you should confirm anything important with a licensed attorney or an official government source.
13. Limitation of liability
To the fullest extent permitted by law, EB3 Hub and its members, officers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost opportunities, lost wages, or immigration outcomes, arising from your use of the site or our services.
Our total aggregate liability arising out of or relating to the site or our services will not exceed the total service fees you have actually paid to EB3 Hub in the twelve months before the event giving rise to the claim.
Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for fraud or for death or personal injury caused by negligence. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
14. Indemnity
You agree to indemnify EB3 Hub against claims, losses and reasonable legal costs arising from your breach of these Terms, your misuse of the site, or information you gave us that was false or misleading.
15. Privacy
Our Privacy Policy and Cookie Policy explain how we handle your personal information and form part of these Terms.
16. Governing law and disputes
These Terms are governed by the laws of the State of New Jersey and the federal laws of the United States, without regard to conflict-of-law rules. You and EB3 Hub agree to the exclusive jurisdiction of the state and federal courts located in New Jersey, and each of us waives any objection to venue there.
Before starting a formal claim, please contact us at [email protected] — most issues are resolved faster in a conversation.
If you are a consumer resident in a country whose law gives you the right to bring proceedings locally, this section does not remove that right.
17. General
- Severability — if any provision is held unenforceable, the rest remains in force.
- No waiver — if we do not enforce a provision, we have not waived it.
- Assignment — you may not assign your rights under these Terms; we may assign ours in connection with a merger or sale of the business.
- Entire agreement — these Terms, the Privacy Policy, Cookie Policy, Refund & Payment Policy, Legal Disclaimer and any signed service agreement are the whole agreement between us on their subject matter.
- Changes — we may update these Terms; the "last updated" date shows the current version, and continuing to use the site after a change means you accept it. Changes do not alter a signed service agreement already in force.
