Privacy Policy

What we collect, why we collect it, who sees it, and how to get it back or have it deleted.

This policy explains what personal information EB3 HUB LLC ("EB3 Hub", "we", "us") collects when you use eb3hub.com or engage us as a client, why we collect it, who we share it with, and the choices you have.

We ask for a lot of personal detail — an EB-3 case cannot be assessed without it. This policy is written so you can see exactly what we hold and why before you decide to share it.

1. Who we are

2. Information we collect

2.1 Information you give us as a candidate

When you complete the eligibility questionnaire or become a client, we collect:

  • Identity and contact details — full name, date of birth, gender, marital status, email address, phone number, preferred contact method and preferred language.
  • Nationality and location — country of birth, country of citizenship, current country and city.
  • Travel and identity documents — whether you hold a valid passport, its expiry date, and (for clients) a copy of the passport photo page.
  • Work and education history — education level, current occupation, years of experience, English level, target job type, availability and willingness to relocate.
  • Immigration history — your current U.S. immigration status, whether you have visited the United States, whether you have ever overstayed a visa, been refused a visa, been deported, or previously applied for a U.S. immigrant visa, and the details you provide about any of these.
  • Family details — whether a spouse is applying with you and whether you have unmarried children under 21, since they may qualify as derivative applicants.
  • Background disclosures — whether you have a criminal record, and any health information you tell us that could affect medical admissibility to the United States.
  • Case correspondence — messages you send us, notes our advisors record about calls and messages, appointment records, and documents you upload to the client portal.
  • How you found us — the referral source you tell us, and the page or campaign that brought you to the site.

2.2 Sensitive information

Two of the categories above are treated as sensitive under many privacy laws: health information and criminal-record disclosures. We collect them only because U.S. immigration law makes medical and criminal admissibility part of the assessment, and only to the extent needed to give you an honest view of your case. We ask for your explicit consent before you submit them, we do not use them for any other purpose, and you may decline — though we may then be unable to assess your eligibility.

2.3 Information employers give us

If you enquire as an employer, we collect your company name, contact name and job title, work email, phone number, business location, industry, number of positions, role description and hiring timeline.

2.4 Information collected automatically

Our web server records standard technical data with each request: IP address, browser and device type, the pages you visit, the referring page, and the date and time. We use this to keep the site secure, diagnose faults, rate-limit abuse and record failed sign-in attempts.

We also count how the site is used — which pages are viewed, which buttons are pressed, and which advert or link a visit came from — so we can tell which parts of the site actually help people. This measurement runs on our own servers and is deliberately minimal: no cookie is set for it, no personal information is recorded, and your IP address is stored only as an irreversible hash. The visit identifier is held in your browser's session storage and is discarded when you close the tab, so you are not recognised on a later visit and never followed onto other websites. These records are deleted after 24 months.

2.5 Client portal accounts

If you receive a client portal account we store your sign-in email, a cryptographic hash of your password (never the password itself), your case reference number, your case stage, your documents, your payment records, and a log of significant actions taken on your case.

3. Why we use your information

  • To assess whether you are likely to qualify for an EB-3 immigrant visa and to tell you honestly if you are not.
  • To match you with a sponsoring U.S. employer and to present your profile to that employer.
  • To prepare and support the PERM, I-140 and consular stages through our partner attorneys and the sponsoring employer.
  • To contact you about your enquiry and your case by phone, WhatsApp, SMS or email.
  • To operate the client portal, take payments, and issue invoices and receipts.
  • To keep records, prevent fraud, secure our systems, and meet legal and regulatory obligations.
  • To improve our services and our website.

We do not use your information to make automated decisions that produce legal effects for you. Eligibility assessments are reviewed by a person.

If you are in a jurisdiction that requires a legal basis for processing, we rely on:

  • Your consent — for the eligibility questionnaire, for marketing messages, and (explicitly) for health and criminal-record information. You may withdraw consent at any time.
  • Performance of a contract — to deliver the services you have engaged us for.
  • Legitimate interests — to secure our systems, prevent fraud, keep business records and improve our services, where those interests are not overridden by your rights.
  • Legal obligation — where we must retain or disclose information by law.

5. Who we share it with

We do not sell your personal information, and we never have. We share it only as follows:

  • Sponsoring U.S. employers — the employer considering you for a role receives the profile information relevant to that hiring decision.
  • Licensed immigration attorneys — the attorneys who prepare and file your case.
  • BDV Solutions — our official partner, where they are involved in placing or sponsoring you.
  • Government agencies — the U.S. Department of Labor, USCIS, the National Visa Center and U.S. consulates receive case information as part of the filings made on your behalf, normally through the employer or attorney rather than directly from us.
  • Service providers — our website host, our email provider, and Stripe, which processes card payments. Stripe receives your payment details directly; we never see or store your full card number.
  • Professional advisers — our own lawyers, accountants and auditors, where needed.
  • Legal requirement — where we are compelled by law, court order, or to protect our rights or someone's safety.

If our business is sold or reorganised, client records may transfer to the acquiring entity, which would remain bound by this policy or a materially equivalent one.

6. International transfers

EB3 Hub operates in the United States and our systems are hosted there. If you are outside the United States — as most of our candidates are — the information you give us will be transferred to and processed in the United States, and shared with U.S. employers, attorneys and government agencies. U.S. law may not give the same protections as the law where you live. By submitting your information you understand that this transfer is necessary for the service you are asking us to provide.

7. How we protect it

  • The whole site is served over encrypted HTTPS connections.
  • Portal and staff passwords are stored as one-way cryptographic hashes.
  • Staff accounts are role-restricted, so each person reaches only the records their job requires.
  • Significant actions on a case are written to an append-only audit log.
  • Uploaded documents are stored outside the public web root and served only to authenticated, authorised users.
  • Sign-in attempts are rate-limited to slow down password guessing.

No system is perfectly secure. If a breach affects your personal information, we will notify you and the relevant regulator where the law requires it.

8. How long we keep it

  • Enquiries that do not become cases — up to 24 months from your last contact with us, then deleted or anonymised.
  • Active client cases — for the life of the case.
  • Closed client cases — up to 7 years after closure, so we can answer questions about a filing and meet tax, accounting and record-keeping obligations.
  • Payment records — as required by tax and accounting law, normally 7 years.
  • Security and audit logs — up to 24 months.

We may keep information longer where a law, a dispute or an ongoing government filing requires it.

9. Your rights

Depending on where you live, you may have the right to:

  • Ask what personal information we hold about you and receive a copy.
  • Have inaccurate information corrected.
  • Ask us to delete information we no longer need.
  • Ask us to restrict or object to certain processing.
  • Receive your information in a portable, machine-readable format.
  • Withdraw consent at any time, without affecting processing already carried out.
  • Not be discriminated against for exercising any of these rights.

To exercise any of them, email [email protected] from the address we hold for you, or write to the postal address above. We respond within 30 days, or 45 days for California requests where the law allows an extension. We may need to verify your identity first, and you may use an authorised agent.

Please note that we cannot delete information that has already been filed with a U.S. government agency, and deleting your case file may make it impossible for us to continue representing your case.

9.1 California residents

Under the CCPA as amended by the CPRA, California residents have the rights to know, delete, correct, and to limit the use of sensitive personal information. We do not sell or share personal information for cross-context behavioural advertising, so there is nothing to opt out of. We use sensitive personal information only for the purposes described in section 2.2, which are permitted uses that do not trigger the right to limit.

9.2 EEA and UK residents

You may lodge a complaint with your local supervisory authority. We would appreciate the chance to address your concern first.

10. Children

Our services are for adults. You must be at least 18 to submit the eligibility questionnaire, and we do not knowingly collect information directly from children. Where a client tells us about a spouse or a child under 21 as a derivative applicant, that information is provided by the adult applicant. If you believe a child has given us information directly, contact us and we will delete it.

11. Marketing

If you consent, we may send you updates about EB-3 opportunities and our services. Every marketing email carries an unsubscribe link, and you can reply STOP to a WhatsApp or SMS message or email us to opt out. Withdrawing marketing consent does not stop the operational messages we need to send you about an active case.

12. Other sites

Our site links to third-party services, including WhatsApp, Facebook and Stripe. Once you follow a link or start a payment, that company's own privacy policy governs what it does with your information. We are not responsible for their practices.

13. Changes to this policy

We may update this policy as our services or the law change. The "last updated" date at the top always reflects the current version. If a change materially affects your rights we will tell active clients directly by email.
